These terms and conditions apply between you (the customer) and Uber Vans Ltd for the acquisition of a UK vehicle(s) supplied by a UK Dealer/Manufacturer. This website is owned and operated by Uber Vans Ltd whose registered office is:

Uber Vans Ltd provides this site to you subject to the following terms and conditions.

Please read these terms and conditions carefully. Once you have paid the £500 holding deposit, you are deemed to have accepted these terms and conditions and thereby have entered into a legally binding contract. The terms and conditions stated need to be read in conjunction with the order you accept from us.

We reserve the right to make changes to these terms and conditions from time to time which will take effect from the date when the changes are posted on this website. Your continued use of this website will constitute your acceptance of any changes to these terms and conditions. Please remember that throughout these terms and conditions when we mention “we”, “us” or “our”, we mean Uber Vans Ltd. When we refer to “you” we mean the customer.  

Uber Vans Ltd t/a Absolute Vans is an Appointed Representative of Automotive Compliance Ltd, which is authorised and regulated by the Financial Conduct Authority (FCA No 497010). Automotive Compliance Ltd’s permissions as a Principal Firm allows Uber Vans Ltd to act as a credit broker, not as a lender, for the introduction to a limited number of finance providers only.

Whilst we have taken all reasonable steps to ensure the accuracy and completeness of the information on our website; all pricing, imagery, descriptions and advertising material are published only to give you an approximate idea of the vehicles for sale and do not form part of the contract between Uber Vans Ltd and the Customer. Consequently, we accept no liability for any losses or damages (whether direct, indirect, special, consequential or otherwise) arising out of errors or omissions contained on our website.  

We reserve the right to make changes to the contents of our website at any time without notice and incurring liability.

Pricing

Uber Vans Ltd use a number of leading funding suppliers to provide their pricing. Each price advertised is unique to an individual funding supplier and therefore may only be available through that supplier. Should you not meet the financial or operational criteria of that particular funding supplier, then Uber Vans Ltd may have to offer you alternative funding from a different supplier, whose price may vary from the one advertised.

Prices quoted exclude VAT unless otherwise stated.  

Uber Vans Ltd reserve the right to withdraw a quotation before or after a vehicle is ordered by you. This may be because of, but shall not be limited to, changes in money costs, manufacturer’s prices, interest rates or residual values and errors in data however so occasioned that result in miscalculation of the quotation.

Prices on the Uber Vans Ltd website are for information purposes only and do not constitute an offer by Uber Vans Ltd which is capable of acceptance by you. Although we endeavour to ensure that all pricing information on our Website is accurate, occasionally an error may occur and goods may be miss-priced or misrepresented.

Quotations

Uber Vans Ltd will provide a quotation for you based on your requirements and will not be held liable for any extras, options or otherwise you fail to adequately describe to us. Uber Vans Ltd reserve the right to withdraw, decline, or accept any quotations produced, either by quotation system, verbally, by post, by facsimile or by electronic mail.

Orders

By signing and returning the order form you are accepting these terms and conditions and agreeing to order your vehicle in accordance with these terms and conditions.  

An order does not create a contract between you and Uber Vans Ltd. For there to be a contract, Uber Vans Ltd must locate you a vehicle with your desired specification at a price acceptable to both you and Uber Vans Ltd.

You must enter into a financial agreement with a finance company, there is no contract to hire a vehicle until the finance agreement is signed by you and the financial agreement has become operational.  

Following an acceptance by you of a quotation by us, you will be required to complete a financial application form.  

Uber Vans Ltd, supply brand new, pre-registered and used vehicles. The term pre-registered relates to vehicles which have never been owned or driven by a normal member of public, but have been registered to a dealer, broker or terms holder prior to delivery to the end-user. Pre-registered vehicles will attract log-book retention of up to 12 months unless otherwise stated. Uber Vans Ltd can source used vehicles but only do so from reputable sources.

Uber Vans Ltd accepts no responsibility for any errors or omissions regarding vehicle model or specification, including any optional extras, if you have accepted the order and these terms and conditions. It is your responsibility to check the vehicle you are ordering is to your requirements.  

Financial applications

By providing your business and/or personal information to us, you authorise us to disclose this information and any other information we hold about you to one or more lenders for, the purpose of considering your finance application. You are also accepting the terms and conditions of the funder.

We rely on you to provide accurate information and relevant documentation. If you are applying on behalf of a Limited Company, you are confirming you have the authority for a credit search to be carried out in the name of the Company and its Directors.  

The finance company will use the information provided to carry out searches with Credit Reference Agencies. A record of this search will be kept and may be used by other lenders in assessing future applications from you or your business. The finance company will make checks with various fraud prevention agencies to detect and prevent fraud.  You will provide any information required by the lender as a condition of their consideration of your finance application. Refusal to do so will result in your finance application being declined.

Deposit

A minimum holding deposit of Five hundred pounds (£500) is required with every order to show the customer’s commitment to purchase. Such a deposit, if it is accepted, will become a holding deposit and represent confirmation by the customer of the vehicle order and acceptance of all terms and conditions. For specialised or custom order vehicles Uber Vans Ltd may request a larger holding deposit, this will be individually negotiated between Uber Vans Ltd and the customer relative to the financial structure of the balance to be paid and is set out on the front of the order form and invoice.

If the customer fails to take delivery and/or pay the balance of the price without lawful reason by the agreed date, Uber Vans Ltd will be entitled to treat the agreement as cancelled by the customer and offer the vehicle for re-sale. Uber Vans Ltd may claim from the customer any reasonable losses suffered which may include but are not limited to stocking charges, dealer fitted options to the vehicle, and any reduction in the value of the vehicle. Uber Vans Ltd will be entitled to use the deposit and any prepayment to reduce its reasonable losses. Any excess will be returned to the customer and any shortfall will be paid by the customer.

Documentation

All documentation required by the finance company must be completed by you and returned to us prior to the delivery of your vehicle being arranged. If documentation is incorrectly completed and/or all supporting documents required by the finance company have not been viewed by ourselves delivery will also not be arranged.  

Delivery

Any outstanding monies owed to Uber Vans Ltd must be paid and cleared by you before delivery will be arranged.  

Delivery timescales are an indication only. Whilst we endeavour to meet any timescale quoted, we will not be held liable for any compensation arising from the delay in delivery of your vehicle(s) whether caused directly or indirectly. This shall include but is not limited to; the loss of enjoyment, use, profit, costs, damages, charges, expenses or otherwise.

Statutory cooling off period observed by finance companies applies to all vehicles and as such, vehicles will not be delivered until the cooling off period has expired. 

Unless stated to the contrary prices include driven delivery within mainland Great Britain. We reserve the right to pass on costs imposed on us by our supplier(s) to certain locations within the UK. However, we will advise you if there is an additional delivery charge prior to you completing the finance documentation. Delivery on a trailer may be available at extra cost.

The customer acknowledges that it is the customer’s responsibility to ensure that the vehicle condition is signed for appropriately upon handover and Uber Vans Ltd will accept no liability for any damage incurred as a result of the journey and/or any damage not noted upon delivery. Should any damage incurred as a result of the journey be proven, Uber Vans Ltd will make the appropriate insurance claim where necessary via the Driving Agency’s named insurer in which case the Driving Agency will be responsible for such a claim and Uber Vans Ltd will not be held responsible.

The customer is aware that when the vehicle is delivered it may not be perfectly clean and may have suffered wear and tear as a result of the journey. The customer accepts that Uber Vans Ltd will not be liable for such wear and tear unless caused as a direct result of negligence by us.

Where one of Uber Vans Ltd nominated drivers has delivered the vehicle to the customer, the mileage shown on the odometer of the vehicle will increase from the mileage indicated on any initial order documentation supplied by Uber Vans Ltd, to reflect the mileage incurred during the journey and will be indicative of the journey in miles from any supplying dealer’s destination and also taking into account and mileage incurred from the vehicle’s original destination when manufactured and road tested or brought into the United Kingdom where applicable.

When a vehicle has bespoke styling options added, including those shown on Über Vans, the vehicle may have to be moved to several locations. As a result, free delivery may not be available on vehicles with bespoke styling options. Delivery on bespoke vehicles can be arranged but may incur additional costs.

Storage

If the buyer fails to take delivery of the Vehicle within 7 days of being notified it is ready for delivery the seller may, at its option, either store it or have it stored by third parties on such terms as the Seller may decide in its absolute discretion. In any event the cost of storage shall be borne by the Buyer.

Part Exchange

Your Part exchange vehicle will be valued based on the information provided by you and relating to the timescale associated with the order of your new vehicle.

The vehicle must be available for inspection by a third party company if required.

Uber Vans Ltd will not be held liable for any costs relating to the part exchange vehicle including but not limited to; change of value relating to the delay in delivery of your new vehicle, misrepresentation of condition by you, undisclosed damage, inaccurate odometer reading or concealed defects.

Failure to provide supporting documentation including but not limited to; documented service history, proof of ownership (V5 document), current MOT certificate, key/radio codes, all keys, locking wheel nuts/bolts and fitted items in accordance to the valuation.

Cancellation

If you wish to cancel your vehicle order prior to delivery you must do so in writing. Such cancellation may result in loss of any monies paid to Uber Vans Ltd subject to our discretion unless you exercise your rights afforded to you under the Consumer Credit Act 1974, the Consumer Protection (Information, Cancellation and Additional Charges) Regulations 2013 or the Financial Services (Distance Marketing) Regulations 2004.

Any additional costs incurred by us due to a cancellation by you will be passed on to you. We will provide evidence of such costs upon request.

General

Uber Vans Ltd may introduce you to our carefully selected panel of finance providers who may then pay us for the introduction. We will not refer you outside of this panel.

Warranty on Uber Styling and Uber Styling accessories varies depending on the specific item. Items including Alloy Wheels, Side Bars, Tow Bars, and Rear View Cameras, etc. are sourced on your behalf from third-party companies. Uber Vans Ltd cannot be held liable for the direct or indirect consequences of these items. Details of specific warranties on specific items can be provided on request. Items that are manufactured on our behalf, such as certain designs of Spoilers, Side Skirts and Wheel Arch Extensions, etc. are covered under a 12-month or 20,000-mile warranty – whichever comes first. Details of these items can be provided on request. The Customer accepts that they may be required to bring their vehicle to our premises for certain warranty work to be inspected and/or carried out. Warranty can be declined for just cause. Examples of such causes include but are not limited to; vandalism, obvious signs of erratic driving (eg. damage to various parts of the vehicle, numerous stone chips, kerbed alloys etc), the use of non-PH neutral cleaning products, the vehicle is frequented to harsh environments including but not limited to coastal areas, etc. Certain items are too big and/or too fragile to be sent by post/courier and the Customer accepts responsibility and/or cost for collecting these items. It is strictly forbidden for any accessory supplied by Uber Vans Ltd to be copied or used to replicate the same/similar product; In such a situation, Uber Vans Ltd retains the right to seek financial compensation.
